Electronic filing regulations for real estate investment funds

It was announced in the Irish Official Gazette (S.I.) No. 368 of 2018 that regulations requiring Irish Real Estate Investment Funds (IREFS) to electronically file annual financial statements – the “Investment Undertaking Electronic Account Filing Requirements Regulations 2018” – were made. 

Under the regulations, enabled by Part 27, section 739FA of the Taxes Consolidation Act 1997, the relevant financial statements (including, inter alia, the auditor’s report, the statement of financial position at the end of a period and the statement of comprehensive income for the period) must be provided electronically (in text-searchable PDF format): 

  • if the accounting year ends on or before June 30 of a year: within 30 days of December 31 of that year; or 
  • if the accounting period ends between July 1 and December 31 of a year: within 30 days of June 30 of the following year. 

For accounting periods ending during 2017, the financial statements must be provided by 30 January 2019.
