Poland B2B KSeF E-Invoices

Type: Legislation

In December 2023, the Polish national accountancy body, SKwP, has raised concerns regarding the development progress of the Ministry of Finance’s mandatory e-invoicing platform, urging a postponement of the scheduled July 1, 2024 launch. The call for delay stems from uncertainties surrounding the platform’s advancement, prompting SKwP to request additional information on the current status. Notably, Poland’s new government has not yet issued a response.

Adding to the developments, on December 3, 2023, a new public consultation on the National e-Invoice System (KSeF) B2B e-invoicing mandate was initiated. This consultation addresses two draft legislative pieces, covering updated technical regulations related to QR Codes, new authorizations, authentication methods, and markings with QR codes for invoices issued in KSeF. Additionally, changes to invoice issuance regulations encompass rules for VAT exempt invoices within KSeF by 2025, as well as guidelines for invoices pertaining to continuous services such as utilities. Stakeholders are encouraged to participate in the consultation to provide insights on these proposed amendments.

Effective date: July 1st, 2024
